LapViz - Terms and Conditions

These terms govern the use of LapViz: the website lapviz.com (with LapViz Studio, the 3D replay and the API) and the LapViz mobile apps ("the Service"). By creating an account or using the Service, You accept them. If You do not accept them, do not use the Service.

Your account

  • You must be at least 13 years old. From 13 to 18, You use the Service with the agreement of a parent or legal guardian, who must agree to any purchase.
  • The information You give must be accurate. One account is for one person; keep Your password and Your API keys secret. You are responsible for what is done with Your account.
  • You can delete Your account at any time in Your settings (Personal data): Your sessions, files and data are deleted with it, as described in the privacy policy.

Free use and LapViz Pro

LapViz is free: importing, timing, analysing and sharing Your sessions, the apps, coaching with Your own coaches and teams. The free use has limits (for instance the budget of the AI coach), which We may change.

LapViz Pro is a paid subscription that adds the benefits shown on the subscription page of Your settings (at the date of these terms: the full budget of the AI coach and unlimited coaching requests to new coaches). Its conditions:

  • Seller: the subscription is sold through Stripe, Our reseller, which is the seller of record: it takes the payment, issues the invoice and collects the taxes. Its terms apply to the payment.
  • Price: the price shown before the payment, taxes included, per month or per year.
  • Renewal: the subscription renews automatically at the end of each period, at the price then in force, until You cancel it.
  • Cancellation: at any time, in Your settings (Subscription) or on the page of Stripe. Pro stays until the end of the period already paid, then does not renew. A period started is not refunded, except as stated below.
  • Change of price: We tell You at least 30 days before it applies, at Your next renewal; You can cancel before.
  • Right of withdrawal (consumers): You can withdraw within 14 days of the subscription, without giving a reason, by writing to support@lapviz.com. As You ask for Pro to start at once, We refund the price minus the share of the period already used.
  • Failed payment: Stripe tries again for some days; without payment, Pro ends.

Your sessions and Your content

  • The sessions, files, notes, comments and other content You send remain Yours. You give Mengal SRL the right to store, process and show them as needed to provide the Service, and to show them to the people You choose with the sharing of each session.
  • A session whose sharing is Public or Lap times is visible to everyone, counts in the rankings and records of the circuits and can appear in search engines. Choose its sharing accordingly; You can change it at any time.
  • You must have the right to send what You send: a session of another driver only with his agreement (or as his coach, parent or team staff), and nothing that infringes the rights of others.

The circuit database

You grant Mengal SRL a non-exclusive, worldwide, royalty-free and perpetual license to use the GPS data of Your sessions and files (positions, speeds and trajectories) to create and improve its circuit database: to place and correct the timing lines, the sectors and the outline of the circuits, and to find the circuits LapViz does not know yet. Mengal SRL publishes this circuit database under an open-source license (MIT) in LapViz.Telemetry and may contribute it to other open circuit databases. Only the circuits are published: never Your name, Your lap times, Your sessions nor the files You sent. A file without laps recorded where LapViz does not know the circuit is kept so that this circuit can be added; once it is added, the file is imported again into Your account and You are told by e-mail. You can object to this use (see the privacy policy).

Acceptable use

You must not:

  • send false sessions, or alter sessions, to appear in the rankings, records or competitions;
  • use the Service against the law or the rights of others, or to harass, insult or deceive other users (in the comments, the coaching requests, the team pages and everywhere else);
  • access accounts or data that are not Yours, bypass the security or the limits of the Service, or disrupt it;
  • collect the data of the Service in bulk other than through the API and its limits, or resell it;
  • copy or republish the Service, its design or its content other than as these terms allow.

We may remove content that breaks these rules and suspend or close the account concerned, after warning You unless the breach is serious or the law requires otherwise.

Coaching and teams

  • The coaches are independent: LapViz only connects drivers and coaches and is not a party to their agreement. A coach who sets a price is paid directly by the driver (through the payment link of the coach); LapViz does not handle these payments and is not responsible for the coaching given.
  • The administrators of LapViz review the coach profiles before they appear, without guaranteeing the qualifications or the quality of a coach.
  • The administrators of a team decide who joins it and what its public page shows, within the rules of the Service.

AI coach

The AI coach answers with an artificial intelligence model. Its answers are information only and may contain mistakes: check them, and never rely on them for Your safety or the setup of a vehicle without the advice of a competent person.

Safety on track

Motorsport is dangerous. Follow the rules and the instructions of the circuit and of the organiser. Do not handle a phone or a device while driving: set it up before, and look at the results after. The lap times of LapViz are measured from the data of Your devices and are not an official timing; their precision depends on these devices. Mengal SRL is not responsible for what happens on track.

Apps, devices and third-party services

The apps are installed from the App Store or Google Play, whose terms also apply. The devices You connect (lap timers, GPS receivers, OBD-II adapters, sensors) are used at Your own risk and under the terms of their makers. The Service uses third-party services (maps, weather, sign-in with Google, Facebook or Apple...) that may change or stop.

API and developers

The API is offered under the conditions of the developer pages and of these terms: use Your own API keys, keep them secret, respect the rate limits and the sharing chosen by each driver. We may revoke a key that is misused.

Intellectual property

The Service, its software, its design and the LapViz name and logo belong to Mengal SRL or its licensors. The open-source components published by LapViz are available under their own licenses. You may link to the Service and embed what the Service offers to embed (share cards, embed codes); You may not use the LapViz name or logo in another way without Our written agreement.

Availability and changes

We do Our best to keep the Service available and Your data safe, but cannot guarantee that it is always available or free of errors. Keep the original files of Your sessions. We may change, add or remove features; a paid benefit removed during a period gives a refund of the remaining share.

Liability

To the extent allowed by law, Mengal SRL is not liable for indirect damages (loss of profit, of chance or of data) and its liability for a paid subscription is limited to the amount You paid in the 12 months before the event. These limits do not apply to fraud, wilful misconduct or gross negligence, to death or personal injury, nor where the law forbids them, in particular the mandatory rights of consumers.

Suspension and termination

You may stop using the Service and delete Your account at any time. We may suspend or close an account that seriously breaches these terms, after warning You where possible; a paid period not used because of such a closure is not refunded. If We stop the Service, We tell You at least 30 days before, You can download Your data, and the remaining share of a paid period is refunded.

Personal data

The privacy policy explains how Your personal data is processed and how You exercise Your rights.

Changes to these terms

We may change these terms. We tell You of an important change by e-mail or by a notice on the Service at least 30 days before it applies. If You do not accept it, You can delete Your account (and cancel a subscription) before; using the Service after means You accept it.

Applicable law and disputes

These terms are governed by Belgian law. As a consumer, You keep the protection of the mandatory rules of the country where You live. In case of a problem, write to Us first at support@lapviz.com. A consumer can also turn to the Belgian Consumer Mediation Service (mediationconsommateur.be). Disputes go to the competent courts: for consumers, those that the law designates; otherwise, the courts of Liège.
